New Mexico Minimum Wage — As of October 2026, the minimum wage in New Mexico is $12.00 per hour, unchanged since 2020, and no increase has been announced for 2027. Tipped workers, such as restaurant servers, may be paid a cash wage of $3.00 per hour, with a tip credit of up to $9.00 — but tips must still bring total earnings to at least $12.00 per hour, and the employer must cover any shortfall. Overtime follows the federal standard: 1.5 times your regular hourly rate for every hour worked over 40 in a single workweek, with no averaging across weeks. Note that some cities set higher rates — Santa Fe’s living wage is $15.40 per hour — so check your local rate. Recordkeeping
Every New Mexico employer must keep true and accurate records of hours worked and wages paid for each employee. These records must be kept on file for at least one year after the entry has been made.
