Mississippi Overtime Laws
Mississippi Minimum Wage — Mississippi has no state minimum wage law, so the federal minimum wage of $7.25 per hour applies statewide. That rate has been unchanged since 2009, and no increase is scheduled for 2027. Tipped workers can be paid a cash wage of $2.13 per hour, but their employer must make up the difference if tips plus wages don’t total at least $7.25 per hour. Mississippi also has no state overtime law — federal overtime rules apply, meaning non-exempt employees must receive 1.5 times their regular rate for all hours worked over 40 in a workweek. Because there is no state agency handling wage claims, workers must file underpayment claims with the U.S. Department of Labor.
